Terms and Conditions of entry (Game of Skill)
1. The Promoter: O'Brien is O'Brien Glass Industries Limited ABN 74 000 022 275 (“O'Brien”) of Unit 1, 45 Davies
Road Padstow NSW 2211.
2. Acceptance of Terms: Instructions and information on how to enter and prizes form part of these Terms and
Conditions. By entering and participating in the O’Brien® AutoGlass AAAA VR Competition (“Promotion”),
entrants agree to be bound by these Conditions of Entry.
Entry
3. Promotional Period: The Promotion commences at 10:00 am AEST on 14/05/26 and ends at 06:00 pm AEST on
16/05/26 (“Promotional Period”).
4. Eligibility: Entry is open to attendees of the AAAA Expo in Melbourne, Australia.
5. Age Requirement: Entrants must be 18 years of age or over.
6. Game of Skill Mechanic: Winner will be determined by the highest points received while completing the VR
headset challenge.
7. Multiple Entries: Entrants can enter more than once.
8. Contact During Promotion: The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s eligibility, identity, age, and place of residence) and to disqualify any entrant
who fails to provide accurate and timely information as requested.
9. Entrants may be contacted by the Promoter during the Promotional Period to verify their eligibility, or clarify
orders submitted. Failure to provide accurate and timely responses may result in disqualification at the
Promoter’s discretion.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to
determine the identity of the entrant or winner.
11. Any costs associated with entering the Promotion, are the entrant’s responsibility.
12. Safety: Entrants must not engage in any illegal or unsafe behaviour whilst participating in the Promotion. To
the extent permitted by law, the Promoter and its partners exclude any legal liability or responsibility for
incidents or activities, whether legal or otherwise, engaged in by you or any other person during participation
in the Promotion. For the sake of clarity, this clause shall not apply where the Promoter has organised or
endorsed any particular activities.
13. Failure to comply with these Terms and Conditions or any other applicable terms may result in
disqualification and/or forfeiture of prizes at the Promoter’s sole discretion.
14. By entering this Promotion, you grant the Promoter and its related entities the right to use, reproduce, modify,
adapt, publish and display the resulting content (including images, video and quotes) in connection with this
Promotion or other future promotional and marketing activities, including but not limited to the Promoter’s
websites, social media channels, third-party media outlets, digital and print advertising, and promotional
collateral, without further reference or compensation to you.
15. If any children appear in the submitted or created promotional content (photos, videos, interviews), the
entrant warrants that they are the legal guardian or have obtained the necessary written consent from the
child’s parent or legal guardian for their image and likeness to be used in connection with this Promotion.
Judging and Prizes
16. The Promotion is a game of skill; chance plays no part in determining the winner.
17. There will be one (1) winner.
18. The winner will be the entrant who receives the highest score in the VR headset challenge.
19. In the event of a tie, the Promoter reserves the right to apply an additional assessment at its discretion to
determine a single winner.
20. The judging will be conducted by an O’Brien AutoGlass employee. The judging will take place at O’Brien Glass
Industries Limited, Head Office, 1/45 Davies Rd, Padstow NSW 2211 commencing 18/05/26.
21. The prize is a $300 gift card.
22. There is one (1) prize.
23. The prize is not transferable, exchangeable, or redeemable for cash.
24. The winner will be notified by telephone or in writing within 7 business days of the promotional end date.
25. The winner must take the prize as offered. The prize, or any unused portion of the prize, is not exchangeable
and cannot be redeemed as cash.
26. If, for any reason, the winner does not take the prize (or part of the prize) within the reasonable time stipulated
by the Promoter, the prize (or that part of the prize) will be forfeited by the winner and cash will not be
awarded in lieu.
27. If a prize, or part of a prize, is unavailable, the Promoter may substitute an alternative prize to substantially
the same recommended retail value and/or specification.
28. Unless otherwise stipulated, the prize will be delivered at the nominated address of the winner. The Promoter
is not responsible or liable for any delay or failure in delivery of the prize by a third party or for any damaged
caused to the prize during delivery.
29. The prize does not include any ancillary costs associated with redeeming the prize, which are the
responsibility of the winner.
30. In accepting the prize, the winner acknowledges that they may incur ongoing costs associated with the prize
that are the responsibility of the winner.
31. The prize is subject to the standard terms and conditions of the individual prize and service providers. The
terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these
Terms and Conditions in the event of any inconsistency. To the extent permitted by law the Promoter accepts
no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure
relating to the prize itself or failure by the third party to meet any of its obligations in these Terms and
Conditions or otherwise.
General
32. The Promoter’s decision in relation to all aspects of the Promotion is final and no correspondence will be
entered into.
33. The Promoter reserves the right to cancel, suspend, or modify the Promotion if circumstances beyond its
control make it unavoidable.
34. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of
computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud,
technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion
cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify
a prize.
35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the
statutory consumer guarantees as provided under the Competition and Consumer Act or similar applicable
laws (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability
(including negligence) for any: (a) personal injury arising in any way out of the Promotion; or (b) any loss or
damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way
out of: (i) the Promotion; (ii) any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (iii) any theft, unauthorised access or third party interference; (iv) any entry or prize claim
that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to
any reason beyond the reasonable control of the Promoter; (v) any variation in prize value to that stated in
these Terms and Conditions; (vi) any tax liability incurred by a winner or entrant; or (vii) use of the prize. For
the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused any personal
injury, loss or damage (in which case the Promoter’s liability is limited to the minimum allowable by law).
36. Subject to the Non-Excludable Guarantees, the Promoter makes no representations or warranty as to the
quality, suitability or merchantability of any of the goods or services offered as a prize.
37. The Promoter collects personal information (“PI”) to conduct the Promotion and may disclose such PI to third
parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry in the
Promotion is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its privacy
policy, which is available at https://www.obrien.com.au/privacy-policy/. In addition to any use that may be
outlined in the Promoter’s privacy policy, the Promoter may also, for an indefinite period, use the PI for
promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or
telephoning you.
By entering the Promotion, entrants consent to the Promoter using their PI for the following purposes:
• contacting entrants after the event about their participation in the Promotion
• sending sales, marketing, promotional and service and product-related communications, including by
email, SMS, and telephone
• conducting research, profiling and audience analysis
• adding entrant details to the O’Brien commercial database for ongoing communications
You should direct any request to opt out, access, update or correct PI to the Promoter and direct any
complaints regarding treatment of your PI as set out in the Promoter’s privacy policy. All entries become the
property of the Promoter.
